Successful Outcomes in Parallel Proceedings
DES MOINES, Iowa (July 23, 2025) – The Firm secured favorable results in parallel proceedings (i.e., both criminal and civil actions) against a former Iowa law enforcement officer.
In April of 2022, the State of Iowa charged 85 discreet criminal counts, including 33 felonies and 52 misdemeanors. Adam Zenor, Allyson Aden, and Sarah Hickman completed comprehensive written discovery, depositions of critical witnesses, and dispositive motion practice. As a result of this work, the Firm obtained dismissal of all but seven (7) counts (two (2) felonies and five (5) misdemeanors), for which the Firm secured concurrent suspended sentences.
On July 7, 2023, civil suit was filed, alleging similar underlying conduct, pursuant to the Iowa Municipal Tort Claims Act. Adam Zenor and Sarah Hickman filed a motion to dismiss the civil claims on the basis they were barred by the statute of limitations governing actions brought under the Iowa Municipal Tort Claims Act. On June 13, 2024, the District Court denied the motion to dismiss. Mr. Zenor and Ms. Hickman successfully applied for interlocutory review and completed appellate briefing and oral argument.
On July 23, 2025, the Iowa Court of Appeals reversed the District Court’s denial and remanded the case with instructions to dismiss all claims against the Firm’s client.
